Please read these terms carefully before using the Orchid Advocates website or engaging our services. By submitting an enquiry form, scheduling an appointment, or instructing us to undertake legal work, you confirm that you have read and agree to these terms.

1. Definitions

In these Terms: "Orchid Advocates", "we", "us" and "our" refer to the law practice at 38 Beach Road, #29-11 South Beach Tower, Singapore 189767. "You" and "your" refer to the individual accessing this website or engaging our services. "Services" refers to the legal services described on this website. "Agreement" means these Terms together with any written engagement letter issued to you.

2. Acceptance of Terms

By using this website or requesting our services, you agree to be bound by these Terms. If you do not agree, please do not use the website or submit any enquiry. You must be at least 18 years of age and legally capable of entering into a binding agreement.

3. Nature of Services

Orchid Advocates provides legal services relating to pension documentation review, pension dispute negotiation, and lasting powers of attorney with pension provisions. The scope of any engagement is defined in a written engagement letter issued before work commences. This website is for information purposes and does not constitute legal advice.

4. Engagement of Services

An engagement begins only when a written engagement letter has been issued by Orchid Advocates and accepted by you (whether in writing or by your conduct in providing instructions). No work is carried out, and no fees become payable, prior to that acceptance. The engagement letter will set out the scope, fee, and expected timeline.

5. User Responsibilities

You agree to:

• Provide accurate and complete information when enquiring or instructing
• Notify us promptly of any change in your circumstances that may affect the matter
• Attend scheduled appointments punctually or give reasonable notice of cancellation
• Not use this website for any unlawful purpose or in a way that could harm others

6. Intellectual Property

All content on this website — including text, design, and structure — is the property of Orchid Advocates and is protected by Singapore copyright law. You may not reproduce, distribute, or adapt any part of this website without our written consent. Written summaries and legal documents produced for your specific engagement are for your personal use only.

7. Fees and Payment

Fees for each service are stated on this website and confirmed in your engagement letter. All fees are in Singapore Dollars (SGD) and are due upon completion of the relevant service unless otherwise agreed in writing. For the OPG registration in LPA matters, the government registration fee is payable separately and directly to the Office of the Public Guardian.

We do not charge for the introductory telephone call. Where a matter is cancelled before any substantive work has commenced, no fee is payable.

8. Refunds

Where a service has been completed and delivered, fees are not refundable. If work is suspended at your request before delivery, we will charge only for work reasonably completed to that point and will refund any balance. Disputes about fees should be raised within 14 days of the engagement letter date.

9. Disclaimers

Our services are provided with professional care and in accordance with Singapore legal practice standards. However, we cannot warrant any particular outcome from legal work, including in dispute matters. Legal situations are subject to facts and circumstances beyond our control, and our assessments represent professional judgment, not certainty.

This website is provided "as available". We do not warrant that it will be uninterrupted or error-free.

10. Limitation of Liability

To the extent permitted by Singapore law, our aggregate liability for any claim arising from a legal engagement is limited to the total fee paid for the specific service giving rise to the claim. We are not liable for indirect, consequential, or special loss, or for loss of data or goodwill.

Nothing in these terms excludes or limits liability for fraud, death or personal injury caused by negligence, or any other matter that cannot lawfully be excluded.

11. Indemnification

You agree to indemnify and hold harmless Orchid Advocates from any claims, losses, or costs arising from your breach of these Terms, your misrepresentation of facts in an engagement, or your unlawful use of this website.

12. Confidentiality

We hold all client information in strict confidence in accordance with our professional obligations and the PDPA. You agree not to disclose the content of any written advice, correspondence, or document produced by us without our consent, except where required by law.

13. Termination

Either party may bring an engagement to a close by giving written notice. Where you terminate an engagement in progress, fees reasonably incurred to that point are payable. We reserve the right to withdraw from an engagement in circumstances where professional obligations require it, in which case we will provide you with reasonable time to arrange alternative assistance.

14. Governing Law and Disputes

These Terms and any engagement are governed by the laws of Singapore. Any dispute arising shall first be subject to informal resolution in writing between the parties. If not resolved within 30 days, either party may refer the matter to the Law Society of Singapore's dispute resolution processes, or to the courts of Singapore.

15. General

If any provision of these Terms is found to be unenforceable, the remainder continues in full effect. Our failure to enforce any right does not constitute a waiver. These Terms, together with any engagement letter, constitute the entire agreement between the parties for the relevant engagement.

16. Changes to these Terms

We may revise these Terms from time to time. The current version is always available on this page. Continued use of our website after a revision constitutes acceptance of the updated terms.
